The applicant for ILR may be granted indefinite leave to remain if the applicant:

  • Has spent a continuous periods of five years here as a representative of an overseas business and/or in one of the predecessor categories of overseas media representative or sole representative.
  • Has met the requirements to be a representative of an overseas business throughout the five year period. The UKBA will check that they still meet all the requirements including that:
  • they have been employed throughout the period for example by providing P60s for the last five years and pay slips for the last three months
  • for sole representatives, they must provide evidence that they have established a branch registered as a UK establishment or subsidiary and generated business. Their employer must still be actively trading and remain centred overseas

If your current permission to stay is as a representative of an overseas newspaper, news agency or broadcasting organisation, you should apply for settlement using application form SET(O).

If your current permission to stay is as a representative of an overseas business, or a sole representative of an overseas business, you should apply using application form SET(BUS).
