Administrative Review EU Settlement Scheme

Administrative Review (AR) against refusal under the EU Settlement Scheme is a process that allows individuals who have had their application for settled or pre-settled status refused to challenge the decision. This review is designed to ensure that any administrative errors made during the initial decision-making process are corrected without the need for a formal appeal. Applicants can request an AR if they believe there has been a caseworking error in the assessment of their application. The request for an AR must be made within 28 days of receiving the refusal decision and must clearly outline the perceived errors. The review is conducted by a different Home Office official than the one who made the original decision, ensuring impartiality. This mechanism provides a vital opportunity for applicants to rectify mistakes and secure their rights under the EU Settlement Scheme.
