A person who has lived in the UK lawfully for a continuous period of 5 years and is currently in the UK as a stateless person can apply for Indefinite Leave to Remain (ILR) as a stateless person.

An application for ILR as a stateless person can be made to the Home Office either by post or through Home Office Premium Service.

Requirements for indefinite leave to remain as a stateless person

According to paragraph 407 of the Immigration Rules, the requirements for indefinite leave to remain as a stateless person are that the applicant:

  1. has made a valid application to the Secretary of State for indefinite leave to remain as a stateless person;
  2. was last granted limited leave to remain as a stateless person in accordance with paragraph 405 of the Immigration Rules;
  3. has spent a continuous period of five years in the United Kingdom with lawful leave, except that any period of overstaying for a period of 28 days or less will be disregarded;
  4. continues to meet the requirements of paragraph 403 of the Immigration Rules.
