Eligibility Requirements For Switching Into BNO Adult Dependent Relative (ADR) Visa

As a BNO adult dependent relative (ADR) of a BNO citizen, you should satisfy the following requirements to be eligible for switching into BNO adult dependent relative (ADR) visa:

  • The applicant must make a valid application for switching into BNO adult dependent relative (ADR) visa;
  • The applicant must meet the relationship requirement as set out in Appendix BN(O);
  • Where the applicant is applying for switching into BNO ADR visa and they have not previously had permission on the Hong Kong BN(O) route the applicant must:(a) as a result of age, illness or disability require long-term personal care to perform everyday tasks; and(b) form part of the same household as the BN(O) Status Holder who has, or is at the same time being granted, permission; and(c) be unable, even with the practical and financial help of the BN(O) Status Holder or the partner of the BN(O) Status Holder, to obtain the required level of help in Hong Kong, if the BN(O) Status Holder or the partner of the BN(O) Status Holder move to the UK, either because the help:(i) is not available, and there is no person in Hong Kong who can reasonably provide it; or(ii) is not affordable.
  • Where the applicant and their partner are the parents or grandparents of the BN(O) Status Holder, or of the partner of the BN(O) Status Holder, the applicant, or their partner, must:(a) as a result of age, illness or disability require long-term personal care to perform everyday tasks; and(b) be unable, even with the practical and financial help of the BN(O) Status Holder or the partner of the BN(O) Status Holder, to obtain the required level of help in Hong Kong if the BN(O) Status Holder or the partner of the BN(O) Status Holder move to the UK either because the help:(i) is not available and there is no person in Hong Kong who can reasonably provide it; or(ii) is not affordable.
  • An applicant applying for switching into BNO adult dependent relative (ADR) visa must be in the UK and must be ordinarily resident in the UK, the Bailiwick of Guernsey, Bailiwick of Jersey, the Isle of Man or Hong Kong on the date of application;
  • If the applicant is applying for switching into BNO adult dependent relative (ADR) visa and has been living in the UK with permission for 12 months or more on the date of application, they will meet the financial requirement. If the applicant is applying for switching into BNO adult dependent relative (ADR) visa and has been in the UK for less than 12 months on the date of application, the decision maker must be satisfied that the applicant or the BN(O) Status Holder are able to maintain and accommodate the applicant adequately in the UK without recourse to public funds for at least 6 months.
  • The applicant must not fall for refusal under Part 9: grounds for refusal;
  • The applicant must not be:
    • in breach of immigration laws, except that where paragraph 39E applies, that period of overstaying will be disregarded; or
    • on immigration bail;
  • If the applicant is applying for switching into BNO adult dependent relative (ADR) visa and:
    • their last grant of permission was for 6 months or less; and
    • the applicant was present in a country listed in Appendix T of these rules for more than six months immediately prior to their last grant of permission,

the applicant must provide a valid medical certificate confirming that they have undergone screening for active pulmonary tuberculosis and that this tuberculosis is not present in them.

Terms & Conditions Of BNO adult dependent relative (ADR) Visa

BNO adult dependent relative (ADR) visa will normally be granted in line with the expiry date of the BN(O) citizen. If the BNO adult dependent relative (ADR) is applying along with the BN(O) citizen, the dependants will either be granted for 30 months or for 60 months depending on for how long the BN(O) citizen has applied for his/her visa. Dependants will be able to apply for extension, if necessary, to complete 5 years in the UK to be eligible for Indefinite Leave to Remainn (ILR) as BNO adult dependent relative (ADR).

The grant will be subject to all the following conditions:

  • no access to public funds; and
  • work (including self-employment and voluntary work) permitted except for employment as a professional sportsperson (including as a sports coach); and
  • study is permitted, subject to the ATAS condition in Appendix ATAS; and
  • if Part 10 applies the applicant will be required to register with the police.
