Administrative Review (AR) Of Turkish ECAA Businessperson Dependant Visa Refusal

The Turkish European Community Association Agreement (ECAA) Businessperson Dependant Visa enables family members of Turkish businesspersons in the UK to join their loved ones. However, a refusal of this visa can be a significant setback. In such cases, applicants have the right to request an Administrative Review (AR) to challenge the decision.

Eligibility Requirements For Turkish ECAA Businessperson Visa AR

To be eligible for an AR of a Turkish ECAA Businessperson Dependant Visa refusal, applicants must meet the following criteria:

  1. Timing: The AR request must be submitted within 28 calendar days of receiving the refusal decision if the applicant is outside the UK, or within 14 calendar days if they are inside the UK.
  2. Grounds for Review: The request must clearly outline the perceived caseworking errors in the original decision. These errors can include:
    • Misinterpretation or misapplication of the evidence provided.
    • Incorrect application of the relevant immigration rules.
    • Failure to consider relevant information or consideration of irrelevant information.
    • Procedural errors that affected the decision.
  3. Supporting Documentation: The applicant should provide any additional evidence or documentation that supports their claim of a caseworking error. This might include marriage or civil partnership certificates, proof of cohabitation, financial statements, or other relevant documents.
